TERMS AND CONDITIONS OF THE ONLINE STORE
The online store alexandrakubas.com respects consumer rights. Consumers may not waive the rights granted to them by the Polish Consumer Rights Act of 30 May 2014. In the event of any inconsistency between these Terms and Conditions and such provisions, the latter shall prevail. The basis and scope of the Seller’s liability towards the consumer for lack of conformity of goods with the contract are set out in the Consumer Rights Act (in particular Articles 43a et seq.).
6.2. The Seller is liable for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within two years of delivery.
6.3. If the goods do not conform to the contract, the consumer may request their repair or replacement. 6.7. If the goods do not conform to the contract, the consumer may declare a price reduction or withdraw from the contract where: (1) the Seller has refused to bring the goods into conformity with the contract; (2) the lack of conformity persists despite the Seller’s attempts to bring the goods into conformity; (3) the lack of conformity is so significant that it justifies a price reduction or withdrawal from the contract without first using repair or replacement.
7. OUT-OF-COURT COMPLAINT AND DISPUTE RESOLUTION

8.4. The Seller will refund all payments received from the consumer, including delivery costs (except for additional costs resulting from a delivery method other than the cheapest standard delivery offered in the Online Store), without undue delay and no later than 14 calendar days from receiving the withdrawal statement.
8.5. The consumer shall return the Product without undue delay and no later than 14 calendar days from the date of withdrawal to the following address: ul. Cząstkowska 34, 01-678 Warsaw, Poland.
8.6. The consumer bears the direct costs of returning the Product.

9. PROVISIONS CONCERNING BUSINESSES
9.1. This section applies only to Customers and Service Users who are not consumers and who are not natural persons concluding a contract directly related to their business activity where the contract shows that it is not of a professional nature for them.
9.2. The Seller may withdraw from a Sales Agreement concluded with such a Customer within 14 calendar days of its conclusion without giving a reason.
9.3. Pursuant to Article 558 § 1 of the Civil Code, the Seller’s liability under the statutory warranty for defects towards a Customer who is not a consumer is excluded.
9.4. Any disputes between the Seller and a Customer who is not a consumer shall be submitted to the court competent for the Seller’s registered office in Poland. This jurisdiction clause does not apply to consumers, to whom the mandatory rules of the European Union and of the country of their habitual residence remain applicable.
10. PERSONAL DATA IN THE ONLINE STORE
10.1. The controller of personal data is Likama Sp. z o.o.
10.2. Detailed rules for the processing of personal data and the rights of Customers in this respect are set out in the Privacy Policy available in the Online Store.
10.3. The Customer has the right to access, rectify, erase or restrict the processing of their data by contacting [email protected].
11. REVIEWS, THEIR VERIFICATION AND DISCOUNTS
11.1. Verification of reviews: the Seller ensures that the Product reviews published in the Online Store come from Customers who have actually purchased the product. Verification consists in allowing only Customers who have made a purchase in the Online Store to post reviews.
11.2. Collection process: to obtain a verified review, the Seller sends the Customer an e-mail with an individual link to the review form. The e-mail is sent automatically, once, 7 days after the Order has been delivered.
11.3. Reward for a review: in return for posting a review (whether positive or negative), the Customer receives a one-time discount code worth 10% on a future purchase in the Online Store. The code is sent to the Customer’s e-mail address once the review has been approved. The discount cannot be combined with other promotions unless the terms of a given promotion provide otherwise.
11.4. Prohibition of unlawful content: it is forbidden to post reviews containing unlawful or vulgar content, content inciting hatred or advertising competitors. The Seller reserves the right not to publish such content.
12. LOYALTY PROGRAMME AND POINTS
12.1. Participation: only Customers with a registered Customer Account in the Online Store take part in the loyalty programme. No points are awarded for purchases made without registration (“as a guest”).
12.2. Earning points: for every full PLN 10 (gross) spent on cosmetics available in the Online Store, the Customer receives 1 loyalty point. Delivery costs are not included in the amount on which points are calculated.
12.3. Value of points: points are converted into fixed-amount discounts, where 1 point corresponds to PLN 1 (one Polish zloty) to be used on future purchases in the Online Store.
12.4. Validity of points: points are valid for 1 year (12 months) from the date they are awarded. Before the points expire, the Customer will receive a reminder e-mail about the approaching expiry and the possibility of using them. After this period, unused points expire.
12.5. Using points: the Customer may use the points to reduce the value of a future order. A maximum of 200 points (corresponding to a discount of PLN 200) may be used per order. The use of points may not reduce the value of the products in an Order below PLN 100 (excluding delivery costs) – a discount coupon issued for points will be accepted if the value of the products after the discount is at least PLN 100. For Orders in EUR or GBP this threshold corresponds to the equivalent of PLN 100 at the exchange rate applied in the Online Store (for example, at the rate applied on 14 October 2026: approx. EUR 23.15 or GBP 19.82). Points cannot be exchanged for cash.
12.6. The points balance can be checked after logging in to the Customer Account.
12.7. Purchases in other currencies: for Orders paid in euro (EUR) or pound sterling (GBP), points are calculated on the equivalent value of the Order in Polish zloty, at the exchange rate applied in the Online Store when the Order is placed. Likewise, when used, a point corresponds to the equivalent of PLN 1 in the currency of the Order. For example, at the exchange rate applied in the Online Store on 12 October 2026: 1 point is awarded for every approx. EUR 2.32 or GBP 1.98 spent, and 1 point corresponds to a discount of approx. EUR 0.23 or GBP 0.20. Exchange rates may change.
12.8. Practical information: a practical explanation of the Loyalty Programme is available on the Loyalty programme page. In the event of any discrepancy, these Terms and Conditions prevail.
13. FINAL PROVISIONS
13.1. Contracts concluded via the Online Store are concluded in Polish. This English translation of the Terms and Conditions is provided for information only; in the event of any discrepancy in interpretation, the Polish version shall prevail.
13.2. The Service Provider reserves the right to amend the Terms and Conditions for important reasons, namely: changes in the law, changes in payment or delivery methods.
13.3. In the event of changes to the Terms and Conditions, Customers with an Account will be notified by e-mail.
13.4. Matters not regulated by these Terms and Conditions are governed by the generally applicable provisions of Polish law, in particular the Civil Code, the Act on the Provision of Electronic Services and the Consumer Rights Act. The mandatory provisions of the law of the country of the consumer’s habitual residence, in particular in the field of consumer protection, remain applicable and are not affected by this choice-of-law clause.
